This policy explains who owns what on NowKind, the license you give us when you post Content, and how we handle copyright complaints. NowKind (the "Services") is operated by GuyFin LLC, a New Jersey limited liability company ("NowKind", "we", "us", "our"). It is part of our Terms of Service (/terms) and works alongside our Acceptable Use Policy (/acceptable-use) and Privacy Policy (/privacy). Terms written with a capital letter and not defined here have the meaning given in our Terms of Service.

What belongs to NowKind
The NowKind name, the NowKind logo, and the look and feel of the site are ours. "NowKind" is a trademark of GuyFin LLC. The software that runs the Services and the design of the site are protected by copyright, (c) GuyFin LLC. You may not copy, adapt, or reuse our name, logo, brand, software, or site design without our written permission, except where the law allows it (for example, fair use, or linking to a page you are entitled to view).
Nothing here stops you from sharing a link to a Page you created or claimed a slot on. That is what NowKind is for.
What belongs to you
You keep ownership of the Content you post. A short story about a Recipient, a photo, a Well-wish, a note on a Claim, drop-off instructions: all of it stays yours. Posting it on NowKind does not transfer ownership to us.
The license you give us
So that we can actually run the Services, you grant us a limited, non-exclusive, royalty-free license to host, store, back up, reproduce, resize, reformat, generate share images from the Page details you enter, and display the Content you post, and, for any photo you may add, to transcode and strip metadata from it. This license exists for one purpose: to operate, secure, and improve the Services and to show your Content to the people you are coordinating help with.
The license is not a license to sell your Content, to hand it to advertisers, or to use it to train models. We do not do those things.
The license ends when you delete the Content or delete the Page it belongs to, with two practical exceptions: copies may remain in routine backups for a limited time, and we may keep Content where the law requires us to, or where we need it to resolve a dispute or enforce our Terms. Deleting a Page removes its Claims, Well-wishes, tasks, and meal slots from the live Services. Be realistic about what deletion can and cannot undo: anything that was public, even briefly, may have been copied or cached by someone else, and that is outside our control.
What you promise when you post
When you post Content, you represent that:
- You own it, or you have the rights and permissions you need to post it and to grant the license above.
- If it is a photo of a person, you have that person's permission to share their image.
- If it is a Page about a Recipient, you have the Recipient's permission, or the permission of their family, to create the Page and to share their name, situation, and any address or other details you enter. This is the same authorization you confirm when you create a Page, and it is a core rule of our Terms of Service (/terms) and Acceptable Use Policy (/acceptable-use).
If you cannot make these promises about a piece of Content, do not post it.
Copyright complaints (DMCA notice and takedown)
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. 512. If you believe Content on NowKind infringes a copyright you own or control, you can send us a notice and we will act on it.
How to send a notice
Send your notice to our designated copyright agent:

To be valid, your notice must include all of the following:
- A description of the copyrighted work you say has been infringed.
- A description of the material you say is infringing, and enough information for us to find it, such as the URL of the Page or the specific photo or text.
- Your name, mailing address, telephone number, and email address so we can reach you.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
- Your physical or electronic signature.
If your notice is missing pieces, we may not be able to act on it, and we may reach out to ask for what is missing.
What we do with a valid notice
When we receive a notice that meets the requirements above, we will remove or disable access to the material promptly. We will also make a reasonable effort to notify the person who posted it that the material was removed and why.
Counter-notice
If your Content was removed and you believe that was a mistake, or that the material was misidentified, you can send a counter-notice to dmca@nowkind.org. A valid counter-notice must include:
- Your name, mailing address, telephone number, and email address.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, made under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which NowKind may be found), and that you will accept service of process from the person who filed the original notice or their agent.
- Your physical or electronic signature.
When we receive a valid counter-notice, we will forward it to the person who sent the original complaint. If that person does not file a court action seeking to restrain the activity within ten to fourteen business days, we may restore the removed material.
Repeat infringers
We will terminate access for, and refuse further use by, people who repeatedly infringe copyright, in appropriate circumstances. Because Supporters do not hold accounts, this means we may block, remove, and refuse future Pages or Content from an Organizer or uploader who is a repeat infringer, and we may suspend the Organizer account behind a Page. This is consistent with our right, stated in the Terms of Service (/terms), to remove Content and suspend accounts at our discretion to protect users.
A note on false claims
Sending a copyright notice or counter-notice with information you know to be false can carry legal liability, including for costs and damages. Please only file if you have a genuine, good-faith claim.
Trademark and other complaints
If your concern is about a trademark, or about someone impersonating a person or misusing private information rather than copying a copyrighted work, that is handled under our Acceptable Use Policy (/acceptable-use) and Terms of Service (/terms). For those, contact abuse@nowkind.org. If a Page is about you and you want it changed or removed, use the "Is this page about you? Request changes or removal" link on the Page, or email abuse@nowkind.org.
Changes to this policy
We may update this policy as the Services change. When we do, we will update the "Last updated" date above. If you have questions, contact us at legal@nowkind.org.
