Acceptable Use Policy

NowKind is a place people turn to during a hard week. A new baby, a surgery, an illness, a loss. The people on these pages are often going through the worst moments of their lives, and many of them never signed up. This policy exists to keep that space safe.

This Acceptable Use Policy is part of our Terms of Service (/terms) and uses the same defined terms (Organizer, Supporter, Recipient, Page, Claim, Claim link, Well-wish, Content). By using the Services, you agree to follow the rules below. Breaking them can result in your Content being removed and your access being suspended (see "How we enforce this"). Where this policy and the Terms of Service overlap, both apply. How we handle the information described here is covered in our Privacy Policy (/privacy).

This document is provided for general information and is not legal advice. If a situation raises legal questions for you, please talk to your own professional.

What NowKind is for

NowKind is for coordinating real, practical help for a real person during a genuine life event: signing up to bring a meal, taking on a task or errand, and leaving a message of support. It is not a fundraising platform, a marketplace, a mailing list, a directory of people, or a way to reach strangers. Use it for the person and the moment it was built for, and nothing else.

Authority, honesty, and identity

A Page publishes real information about a real person, often including their situation and, behind a Claim link, their home address. That only works if the people creating Pages have the right to do so.

You must not:

  • Create a Page about an identifiable person without permission from that Recipient or their family. If you cannot honestly confirm you have their authority, do not create the Page.
  • Misrepresent your relationship to the Recipient, or your reason for creating or joining a Page.
  • Impersonate any person or organization, including the Recipient, another Organizer, a Supporter, NowKind, or anyone else, or falsely suggest you are affiliated with or endorsed by them.
  • Provide false, misleading, or stolen information when you create a Page, claim a slot, or leave a Well-wish.

When you create a Page, you confirm you have the Recipient's (or their family's) permission to create it and to share the information on it. That confirmation is part of the Terms of Service, and it is on you.

Harassment, hate, and threats

NowKind is built around people who are vulnerable. There is no room here for cruelty.

You must not use the Services to:

  • Harass, bully, intimidate, or target any person, including the Recipient, an Organizer, a Supporter, or anyone else.
  • Threaten violence, encourage self-harm, or wish harm on anyone.
  • Attack or demean people based on race, ethnicity, national origin, religion, disability, illness, age, sex, gender identity, sexual orientation, or any similar characteristic.
  • Post content designed to shame, provoke, or humiliate a person going through a crisis.

Privacy and other people's information

Pages already carry sensitive information under careful controls. Do not add to what is exposed, and do not expose anyone else.

You must not:

  • Post the private information of a third party without their permission, including their home address, phone number, email, financial details, or other personal data.
  • Publish a Recipient's contact details, address, or location beyond what the Page is designed to share. The drop-off address is meant to be seen only by a Supporter with an active Claim, through their private Claim link. Do not repost it elsewhere, screenshot it into a Well-wish, or share it with people who have not claimed a slot.
  • Reveal or share a Claim link, or another person's Claim link, with anyone other than the Supporter it belongs to.
  • Collect, scrape, or compile information about the people on NowKind for any purpose.

No scams, fraud, or deceptive requests

You must not use the Services to deceive people or to solicit money or goods under false pretenses. This includes:

  • Creating a fake or exaggerated situation, or a Page for a person or event that is not real.
  • Deceptive or misleading requests for help, money, gift cards, goods, or services.
  • Phishing, or any attempt to trick people into revealing personal or financial information.
  • Directing Supporters off NowKind to collect payments or personal data in a way that misrepresents who you are or what the help is for.

NowKind does not process, hold, or route money. The only money mechanism on a Page is an optional link out to the Recipient's own outside account (for example Venmo, PayPal, or GoFundMe). If you add such a link, it is your responsibility: the link must genuinely benefit the Recipient it is presented for, and you must not use it to solicit money under false pretenses, misdirect it to yourself, or otherwise deceive Supporters. Any payment made through it happens on that third party's service, between the giver and that service; NowKind does not verify or guarantee it.

Illegal, adult, and harmful content

You must not post Content or use the Services for anything that is:

  • Illegal, or that promotes or facilitates illegal activity.
  • Sexually explicit or pornographic, or otherwise adult content.
  • Harmful to minors in any way, including any sexualized depiction of a child. We report child sexual abuse material to the appropriate authorities.
  • Violent, gratuitously graphic, or designed to shock.
  • Promoting the sale of regulated or dangerous goods (for example weapons, drugs, or similar).

No clinical or diagnostic medical detail

A Page can say enough for people to understand why help is needed. It should not become a medical record.

Do not post clinical, diagnostic, or detailed medical information about the Recipient. That includes diagnoses, test results, treatment plans, medication details, prognoses, and similar clinical detail, whether about the Recipient or anyone else. Keep the situation to the plain, human level ("recovering from surgery," "welcoming a new baby," "grieving a loss"). NowKind is not a health platform and is not built to hold this kind of information, so please do not put it here.

Spam, automation, and interference

NowKind's invites work because they go to people you actually know. Keep it that way, and keep the Services running for everyone.

You must not:

  • Use invites to reach people the Organizer does not personally know, or send unsolicited or bulk invitations. Only invite people you have a real connection to.
  • Send spam, chain messages, advertising, or promotional content through any part of the Services.
  • Use bots, scripts, or other automated means to create Pages, claims, Well-wishes, invites, or accounts, or to otherwise interact with the Services at scale.
  • Scrape, harvest, crawl, or index the Services or the Content on it.
  • Probe, scan, or test the vulnerability of the Services, or breach or try to breach security or authentication.
  • Overload, flood, or interfere with the Services or the infrastructure behind them, or interfere with anyone else's use of them.
  • Upload or transmit malware, or any code or file intended to harm, disrupt, or gain unauthorized access to a system.

Do not defeat our safety controls

The controls that protect Recipients only work if they are left in place.

You must not:

  • Work around, defeat, or interfere with any safety, privacy, moderation, or rate-limiting control.
  • Try to make a Page or its Content publicly discoverable or indexable against its settings, including defeating the search-engine noindex setting on Pages.
  • Circumvent or attack the Claim link protections that gate the drop-off address and a Supporter's ability to edit or cancel their own Claim, or try to view an address or Claim you are not entitled to.
  • Attempt to guess, enumerate, or brute-force Page URLs, Claim links, or other tokens.

How to report a problem or request removal

If you see something that breaks this policy, or a Page that involves you, you do not need an account to tell us.

  • Report a Page, a Well-wish, or other Content: email abuse@nowkind.org. Tell us which Page and what is wrong.
  • Report a deceptive money link or a fraudulent Page: email abuse@nowkind.org. If a Page is soliciting money under false pretenses or without authority, or its outside money link looks deceptive, tell us which Page and why. NowKind does not process or hold the money and cannot recover or refund a payment you made on an outside service, but we can act on the Page itself under our enforcement right below, including removing it. A payment made on an outside service is governed by that service; contact them and your bank about the payment.
  • "Is this Page about you? Request changes or removal": if a Page is about you and you did not authorize it, or you want your information changed or removed, use the "Is this page about you?" link on the Page, or email abuse@nowkind.org. Tell us which Page and what you need, and we will look into it.

We review reports and act as described below. We cannot promise a specific outcome for every report, but every report about a person's safety or a Page published without authority is taken seriously.

How we enforce this

We may remove Pages or Content and suspend accounts at our discretion, with or without notice, to protect users. We may do this in response to a report or on our own initiative. Depending on what happened, we may also unpublish a Page, remove Content, suspend the Organizer account behind a Page, or take other steps we think are appropriate.

We do not pre-screen Content, and we are not obligated to monitor it. When we do act, we try to act reasonably and in a way that protects the people involved, but the decision is ours to make.

If your access is suspended, you may still owe the obligations in the Terms of Service that survive termination. If you believe we acted in error, contact legal@nowkind.org.

Changes to this policy

We may update this Acceptable Use Policy as the Services change. When we do, we will update the "Last updated" date above, and significant changes will be reflected on this page. Continuing to use the Services after a change means you accept the updated policy.
